Lori Vallow Daybell was in court Wednesday for a last-minute hearing.
Daybell was present in court for what was described as a hearing to determine witnesses that can be present or that need to be excluded during trial based on the exclusionary witness rule.
Certain witnesses can be excluded from being present in court during the testimony of other witnesses if the court believes that the testimony given by one witness could potentially influence the testimony of another witness.
The hearing is to determine who is considered a witness under the law, and then which witnesses should be excluded from the trial during testimony.
The prosecution and Lori’s defense team argued over who in this case could meet the legal definition of victim, including Kay and Larry Woodcock, JJ Vallow’s grandparents.
The prosecution argued in favor of the Woodcocks, Colby Ryan who is Lori’s oldest son, and Summer Shiftlet who is Lori’s sister to the victim’s list.
