Guard Activation is Title 32, Not Title 10…So What’s The Difference?

Boise (670 KBOI) – Some states are telling President Trump they’ll send National Guard troops to the Mexican border if they’re asked to, while some governors — Kate Brown of Oregon most notably — have said they wouldn’t.

That has many people wondering how a governor could refuse a call-up order by the President.

MAJ Chris Borders with the Idaho National Guard says there are two types of activation orders, Title 10 and Title 32 (of US Code).

“We’re in a Title 32 status when we go help our fire fighters,” said Borders.  “And under Title 32, our Commander-in Chief is the Governor of Idaho.  When we are activated under a Title 10 status, that’s typically to go overseas to fight and win our nation’s wars.”

When the 116th Cavalry Brigade, the 1/183rd and 1/168th Aviation Regiments, and the various units of the Idaho Air National Guard deployed to Iraq and Afghanistan, those were Title 10 activations.

As yet, Idaho National Guardsmen have not been notified of a pending activation.
