Kinner trial delayed until 2021

 

The man charged with fatally stabbing a 3 year old and wounding eight others in June of 2018 won’t now stand trial until 2021.

Timmy Kinner Jr. who is charged with first-degree murder and 12 other felonies, was just declared competent to stand trial earlier this month, after he was treated in a mental health facility for around nine months.

In court Wednesday, defense attorney’s argued they have 21,000 pages of discovery to review and didn’t have the opportunity to work with Kinner while he was being treated.

The Idaho Statesman reports Kinner’s attorney’s asked a judge for a trial date in late 2021, while Ada County prosecutors asked for a trial date in September of 2020.

Fourth District Judge Nancy Baskin landed in the middle and said she would chose a date in “early 2021.”

Kinner has waived his right to a speedy trial, and a final date will not be set until after Judge Baskin reviews other motions in November.
