For the second time in the case of a Boise man accused of raping a woman last year, attorneys Monday gave opening statements before a jury at trial.
Zackary Byrd – who is just 18 is charged with rape dating back to September of 2018.
The Idaho Press reports, the prosecution says he sexually assaulted a woman whose house he lived at in northwest Boise.
The victim said in court Monday, in the early morning hours of Sept. 2nd, she awoke from a light sleep to find Byrd standing over her. He then raped her.
Byrd’s first trial took place in April and ended when a jury could not make a unanimous decision about his guilt. That triggered a mistrial.
The trial is scheduled to last through Wednesday. In Idaho, rape is punishable by up to life in prison.
