Former Canyon County Prisoner Paid for Unlawful Detaining

Caldwell (670 KBOI News) – A former prisoner at the Canyon County Jail was paid  $13,000, after he was not allowed to post bond for a misdemeanor DUI arrest, because of a federal immigration detainer.

According to the Idaho Press, Gustavo Carrera-Garcia was paid the money back in December. He was arrested for DUI in May of 2015.

Federal Immigration and Customs Enforcement and Homeland Security officials are also named in Carrera’s lawsuit.

The suit maintains counties aren’t allowed to arrest people for violations of federal immigration law, and can’t hold them in jail for immigration detainers alone.

Two other men are suing the county for the same reason.
