A man convicted of domestic battery has been arrested for a third time in two years, accused of battering the same victim at a Caldwell residence.
Toby Smitherman, faces felony charges of attempted strangulation and domestic battery in the presence of a child. He was on probation for a previous domestic battery charge at the time of his arrest.
The Idaho Press reports, officers arrived to find the victim shaking uncontrollably and having a hard time talking. She had a swollen eye, and red and purple finger marks around her throat.
Twice in 2017 he was arrested on domestic battery charges at the same Caldwell residence.
In Montana in 2009, Smitherman was also arrested for threatening multiple women with a sawed-off shotgun. He pleaded guilty to those charges.
Smitherman is being held in the Canyon County jail on a $250,000 bond.
