9th US Circuit Court Rules Against Boise on Homeless Ordinance

Boise (670 KBOI News) – The 9th US Circuit Court of Appeals rules against the City of Boise in a homeless camping lawsuit that made national news last fall.

Boise had asked the Court to have 11 judges rehear the arguments in Martin v. City of Boise, in which a three-judge panel had ruled the City’s ban on sleeping on the streets and in parks unconstitutional.

The plaintiffs in the case claimed the City’s ordinance violated the 8th Amendment protection against cruel and unusual punishment, because they had nowhere else to sleep.

City spokesman Mike Journee told the Idaho Statesman the City’s lawyers were looking at the ruling, and they would make an announcement as to their next steps after they had considered their options.
