Eagle (670 KBOI News) – The man convicted of a high-profile drunk driving death in Eagle in November 2017 is appealing his conviction, raising probable cause and other issues.

The Idaho Statesman is reporting Adam Paulson is appealing his conviction in the death of Madeline Duskey to the Idaho Supreme Court.

Among the issues raised by his legal team, are questions about the magistrate court’s finding of probable cause, not granting Paulson’s motion to dismiss the case, and was there sufficient evidence to convict Paulson.

He was convicted of bring drunk the morning Duskey, who herself had been drinking at a nearby restaurant, in a dimly-lit area of Eagle Road, near Riverside Drive…she was not in a crosswalk at the time.

His lawyer argued that given she was wearing dark clothing and it was early in the morning, even a sober driver would have probably hit her.

The case attracted national attention from Mothers Against Drunk Driving.
