The Idaho Supreme Court rules Medicaid Expansion is legal

The Idaho Supreme Court has rejected the Idaho Freedom Foundation’s claim that the voter-passed Medicaid expansion initiative is unconstitutional.

The opinion was written by Chief Justice Roger Burdick, saying the Medicaid Expansion in the Gem State is indeed constitutional.

The Idaho Press reports, Burdick wrote that the Freedom Foundation’s argument that the initiative was an unconstitutional delegation of lawmaking authority to the federal government was “without merit.”

The opinion includes a list of examples from existing Idaho laws that reference federal statutes, from education laws to the Idaho Public Records Act.

Proposition Two, which brought Medicaid Expansion to Idaho, passed last November with 61-percent of the statewide vote. In some counties, it garnered more than 70-percent approval.
