Two Candidates Back on the Ballot After Being Crossed Off

Boise (670 KBOI News) – Two candidates for the Idaho Statehouse are back on the Primary election ballot, after having been taken off due to residency questions.

Deputy Secretary of State Tim Hurst says the names of Former Representative Phil Hart and former Representative Kathy Simms were crossed off the ballots in District 7 and District 4, respectively.

“One of them, Kathy Simms, went to court and asked for a temporary restraining order, to stop us from marking her name off the ballot” said Hurst.  “The judge issued the temporary restraining order because it was so close to the election.  With Phil Hart, we don’t have a decision on that, but we decided if we’re leaving her on, we’ll leave him on and see what happens afterward.”

Hurst says depending on the Primary Day voting, it may be a moot point, but if either Hart or Simms get their party’s nominations, they’ll cross that bridge when they come to it.

Meanwhile, Hurst says anyone who voted by absentee ballot, and signed the affidavit on the back, and have that ballot destroyed if they want to change their vote.

Anyone voting early but not on an absentee ballot, Hurst says there’s nothing they can do about that.
